At its meeting on Tuesday 17 March 2026 Council endorsed the Variation to the Voluntary Planning Agreement – Precinct 75, St Peters for public exhibition.

Background

Precinct 75, St Peters was approved under DA/2021/0800 on 14 March 2023, for demolition of existing structures and construction of a mixed-use development. Under the Housing Delivery Authority development review process, the site was declared to be State Significant Development (SSD) for the purposes of providing shop-top housing with provision of build-to-rent affordable housing.

  • A Voluntary Planning Agreement (VPA) was negotiated, exhibited and approved in June 2020.
  • Following public feedback, Council executed the VPA in June 2023.
  • In August 2025, Council as the consent authority, approved MOD/2025/0010 increasing the size of Council’s Artist Studios from 239 sqm to 250 sqm under the VPA.
  • In May 2026, the Department of Planning, Housing and Infrastructure (DPHI) as the consent authority, approved SSD-82639959 including a concurrent rezoning with an amendment to an existing consent to increase the approved dwellings from 206 to 464 and covert commercial uses to residential.

Key features of the Variation to the VPA

SSD-82639959 requires a variation to the VPA comprising:

  • Formalise the increase of the Artist Studios from 239 sqm to 250 sqm and including an improvement in the fit-out specifications and splitting into three-separable multi-user tenancies.
  • Allow Council and the Developer to enter into a separate management agreement to operate and manage the Artist Studios including safeguards for Council to step-in should the Developer not fulfil its obligations under the management agreement, at no cost to Council.
  • Increase the provision of publicly accessible open space to 1,550 sqm in total.
  • Amend the timing of handover for both the Artist Studios and publicly accessible open space to coincide with issue of Occupancy Certificates for completed parts of the project as per the approved staging plan.
