Council is seeking your feedback on the proposed site-specific amendments to the Inner West Local Environmental Plan (IWLEP) 2022 and draft Development Control Plan (DCP) for 75-85 Crown Street and 116 Princes Highway, St Peters.


Project details


The Planning Proposal for 75-85 Crown Street and 116 Princes Highway, St Peters (the Site) will facilitate a 9 storey mixed use development including approximately 65 residential units and 1,016sqm of commercial/retail space.

The Planning Proposal seeks to amend the IWLEP to:

  • Rezone 75 Crown Street from R1 General Residential to MU1 Mixed Use,
  • Increase the maximum Height of Buildings control from 9.5m and 14m to RL 51m (approximately 9 storeys)
  • Increase the maximum Floor Space Ratio control from 0.85:1 and 1.75:1 to 4:1,
  • Introduce a new local provision to:
    • allow residential accommodation at ground floor, provided it is part of a mixed-use development and contains no more than 88 sqm of residential Gross Floor Area (GFA) at ground level, and
    • require 2% of new residential GFA on the site to be provided as affordable housing, either as:
      • dwellings provided on-site and dedicated to Council in perpetuity, or
      • as an equivalent monetary contribution paid to Council.


The Planning Proposal is accompanied by a site-specific DCP.

Matters addressed in the DCP relate to:

  • Land use
  • Built form, height and design
  • Open space and landscaping
  • Air Quality
  • Affordable housing
  • Sustainability


NSW Department of Planning, Housing and Infrastructure (DPHI) has issued a Gateway Determination allowing the Planning Proposal to proceed to public exhibition, subject to certain changes which have now been implemented. Council has been given delegation to make the plan as the Local Plan Making Authority.

Note: Unlike a Development Application, a Planning Proposal is intended solely to amend the planning controls that apply to the site. Additional approvals will be required for any future development applications related to the site.

Background


At its meeting on 17 June 2025, Council resolved the following:

1. Support the Planning Proposal for 75-85 Crown Street and 116 Princes Highway St Peters to amend the Inner West Local Environmental Plan 2022, proceeding to Gateway subject to the following:

a. Reduce the maximum Floor Space Ratio (FSR) to 4:1.
b. Include a site-specific local provision requiring at least 2% of new residential Gross Floor Area (GFA) be provided as affordable housing, managed by a registered community housing provider in perpetuity.

2. Forward the Planning Proposal to the NSW Department of Planning, Housing and Infrastructure for a Gateway Determination in accordance with section 3.34 of the Environmental Planning and Assessment Act 1979, requesting the following Gateway conditions:

a. Planning Proposal document be updated consistent with the reduced FSR and affordable housing requirement;
b. Urban Design Report be updated illustrating the built form outcome consistent with reduced FSR, including a reference scheme showing the corresponding GFA and number of dwellings;
c. Traffic Impact Assessment be updated and include a strategic-level Green Travel Plan demonstrating mechanisms for delivering effective mode shift;
d. Sustainability strategy be prepared to demonstrate a commitment to exceed minimum sustainability requirements established by standards such as NABERS, BASIX, or NatHERS; and
e. Site-specific amendment to Marrickville Development Control Plan 2011 be updated to be consistent with the updated Planning Proposal and other supporting documents.

3. Request the NSW Department of Planning, Housing and Infrastructure to authorise Council to be the Local Plan Making Authority (LPMA), and if Council is authorised as the LPMA, Council delegate the plan making functions to Director Planning to exercise the function in accordance with the LEP Making Guideline.

4. Following receipt of an affirmative Gateway Determination and compliance with its conditions, agree to place the updated Planning Proposal and supporting documentation on public exhibition for a minimum of 28 days and consult with public authorities in accordance with the Gateway Determination

5. Receive a post exhibition report for its consideration.

On 23 September 2025, DPHI issued a Gateway Determination allowing the Planning Proposal to proceed to public exhibition, subject to certain conditions being satisfied prior to exhibition beginning. These included:

  1. Updating the Planning Proposal to:
    • Reflect an FSR of 4:1 and affordable housing rate of 2% (and confirm the mechanism and arrangements to support the delivery of affordable housing),
    • Reflect the current Key Sites mapping,
    • Rezone the entirety of the site to MU1 Mixed Use zoning,
    • Include evidence of consultation which has occurred with Transport for NSW to date,
    • Provide a project timeframe consistent with the Gateway Determination,
    • Consult with Sydney Airport and the Commonwealth Department of Infrastructure, Regional Development and Cities (DIRDC), regarding consistency with section 9.1 Direction 5.3 Development Near Regulated Airports and Defence Airfields, and update the Planning Proposal with the outcomes of this consultation.
  2. Consulting with Sydney Airport and the Commonwealth Department of Infrastructure, Regional Development and Cities (DIRDC), regarding consistency with section 9.1 Direction 5.3 Development Near Regulated Airports and Defence Airfields, and updating the Planning Proposal with the outcomes of this consultation.

What happens next?


After this consultation closes, we will consider all feedback received and report the outcomes to Council. If Council approves the Planning Proposal, the proposed amendments to IWLEP 2022 and the draft DCP will be finalised.
